Dr Mutua who spoke to the media shortly after the ruling which stripped him his job has vowed to head to the Supreme Court to appeal the decision.
“The court has not looked at critical issues in the election, the validity of the results, tallying and also many other things.
“We are appealing this decision and in the meantime, I am still the governor of Machakos and I am the fifth president of Kenya, by the will of God. I urge the people of Machakos to remain calm as we work on this,” the governor said.

Dr Mutua’s election was on Friday nullified after the Court of Appeal ruled that his election on August 8 did not meet the constitutional standards.
Mutua's win was initially contested at the High Court which ruled in his favour. Wavinya Ndeti, moved to the Court of Appeal which on Friday nullified the gubernatorial results of August 8.
“Let him move to the Supreme Court, but I am moving to heaven, as God will guide the people of Machakos again. If he is the governor as he is saying, let him accept to go the ground again,” the crying Wavinya told a media briefing.
