The High Court made the ruling on Friday, citing violation of Miguna's rights.

The two were also directed to pay the embattled lawyer an additional Ksh270,000 for damage to Miguna's property in order to deter such actions by "overzealous" state officers.

On Friday, the court ruled that taxpayers should not shoulder costs of violations by overzealous state officers adding that the action was made to deter future violations.

Justice Chacha Mwita maintained that Miguna was not an immigrant to Canada and therefore he could not lose Kenyan citizenship when he acquired Canadian citizenship.

The judge also quashed a January 30 gazette notice outlawing Miguna’s National Resistance Movement over which he had declared himself general.

Deportation

While deporting Miguna in March, the State had argued that the outspoken opposition activist lost his Kenyan citizenship when he acquired a Canadian passport at a time the Kenyan constitution did not provide for dual citizenship.

Miguna was been deported twice despite a court order directing the government to release him from detention at Jomo Kenyatta airport in Nairobi.

Sedated

Some of the lawyers on Miguna's defence team claimed that he had been sedated and handcuffed before he was deported.

Dr Miguna, was admitted at a hospital in Dubai, where he told journalists that he was harassed, drugged and dragged to a Dubai-bound flight EK 722.

“I am innocent man,” he said. “My only crimes are that I swore Raila Odinga in as The People’s President on January 30, 2018," Miguna had stated.
