This was revealed by Sabatia legislator Alfred Agoi at an event graced by Raila Odinga.
Although Agoi did not reveal the name of the judge selected for the high profile event, his revelation excited thousands of opposition supporters who were present at the event.
Addressing the mourners in Vihiga during the burial of people who perished in an accident along the Kitale-Webuye road, the opposition chief made it clear that NASA had not given up and was running out of patience.
Odinga stated that "Uhuru Kenyatta thinks that we have given up on swearing in. I want to tell him that we are running out of patience on electoral reforms."
Amidst cheers from mourners, Vihiga Senator George Khaniri who also attended the event urged the opposition chief not to give up.
"Baba we respect you a lot but you are letting us down. Don't loosen your stand. Don't be the first one to drop out," Khaniri added.
The opposition is set to unveil a timetable and other details of the event today even after the Attorney General Githu Muigai advised that the planned swearing in is an act of treason punishable by death.
Earlier on, the opposition postponed the event to pave way for dialogue on electoral justice and reforms.
However, President Uhuru Kenyatta has made it clear on numerous occasions that he will not engage in any dialogue apart from that focussing on his development agenda for the nation.
For fear of a crackdown, the opposition has kept details of the event a top secret with the steering committee formed to coordinate the event operating without a chairperson.
