3 Cabinet Secretaries in trouble after NASA court presentation
NASA revealed the identity of three Cabinet Secretaries who had acted in contravention of the law.
NASA through their lawyer Okongo Omogeni has accused Cabinet Secretaries Eugene Wamalwa (Water), Mwangi Kiunjuri (Devolution) and Joe Mucheru (ICT) of breaking the law through biasness and intimidating Kenyans.
NASA now wants the Supreme Court to find the three to have violated the the Leadership and Integrity Act and the Constitution.
Omogeni argued that public officers according to the constitution are barred from takings sides during campaigns and that State officers are not allowed to use state resources to campaign for any candidate.
“Devolution CS Mwangi Kiunjuri intimidated voters in Taita Taveta County to vote for Jubilee while CS Mucheru broke the law by showing impunity,” Omogeni stated.
The NASA lawyers also stated that Wamalwa, Kiunjuri and Mucheru have still not explained why they took part in campaigns or filed an affidavit to deny their participation in political campaigns.
In April however, The Independent Electoral and Boundaries Commission (IEBC) said cabinet secretaries are free to campaign for President Uhuru Kenyatta ahead of the August polls, despite protests by the Opposition, which had called for their neutrality.
IEBC chairman Wafula Chebukati said ministers are exempted from the law barring civil servants from campaigning.
Mr Chebukati also said there was no way the commission could block a sitting President or governor from using state resources to campaign.
