Marianne Kitany has been accused by her estranged husband, Senator Mithika Linturi of forging divorce papers.

According to the Meru Senator, Ms Kitany forged papers which showed he had divorced his wife Mercy Kaimenyi whom he married in April 2005.

Through documents presented in court, the divorce registered under No. 128 of 2005 was between Elizabeth Ann Patricia Hennessy vs. Parrie Andrew Hennessy and not Franklin Mithika Vs. Mercy Kaimenyi.

Genuineness of the divorce

Senator Linturi's lawyer wrote to the registrar's office seeking to confirm the genuineness of the divorce petition filed at the Meru Law Courts.

A letter from the deputy registrar reads: “The entry in the Register shows that it is a concluded matter and we have confirmed from Kenya Law Reports that the judgement is reported as E.A.P.H v. P.A.H (2011 ).”

The registrar asked for more time to conduct a search for the original file.

Denied any matrimonial ties

Senator Linturi denied having any matrimonial ties with estranged ‘wife’ Maryanne Kitany saying that he was in a monogamous relationship with only one woman who is not Kitany.

He further argued that he only allowed Kitany at his house as a visitor and “that’s why she was evicted when she claimed that she is married.”

The Meru Senator has faced hurdles in the ongoing case after the High Court directed him not to withdraw, transfer or interfere with monies held in several bank accounts.

He together with his agents were barred from interfering with six matrimonial properties which include Kajiado/Kitengela /25310 among others.
