Former Ruaraka OCS Nahashon Mutua sentenced to death for killing inmate Martin Koome in 2013.

The death sentence was handed on Thursday by Justice Stella Mutuku who had indicated that the evidence before court proved that Mutua tortured and killed Koome while in custody at Ruaraka police station.

Justice Mutuku, during the sentencing, said that Koome had received inhumane treatment and the prosecution had proved beyond reasonable doubt that Mutua was the cause of his death.

Proven guilty

The Prosecution has proved beyond reasonable doubt that the police caused the deceased suffering while in cells which caused his death,” Lady Justice Stella Mutuku ruled on Thursday.

The Court had ruled that the element of malice afterthought has been proven further directing that a probation report and impact report be prepared before sentencing.

Mutua had denied the charges saying that he was on duty and was informed of Koome having been injured and he directed he be taken to the hospital.
