The High Court has now reinstated hate speech and incitement to violence charges against the ex-senator.
The decision was made by Justice Grace Machari after the DPP appealed the decision of the lower court which had dismissed the charges.
"Muthama shall appear before the chief magistrate court on October 6 for purposes of taking hearing dates," Machari said.
The move comes hours after Muthama divulged that the Government was reviving old cases to frustrate and finish him politically.
“I am a target of Jubilee leadership, from top to bottom. For quite some time, Jubilee has used its agents to harass and silence me politically,” Muthama stated.Muthama, who is part of Raila Odinga's presidential campaigns, had earlier questioned why he was being re-arrested for hate speech charges that he had faced and freed by the court.
