DP Ruto had been ordered by High Court Judge Roslyne Ougo to pay a whopping Sh5 million to one Adrian Muteshi, for illegally acquiring his piece of land.

Mr. Ruto through his lawyer divulged that he had withdrawn his application appealing the decision by Judge Ougo noting that he would be pursuing the original owner of the land.

According to the DP, the owner who is a woman identified as Dorothy Jemutai Yator, was behind his current predicaments.

"We are going for the people who sold the land to us because they are the people who put us in difficulties,” Ruto’s lawyer Katwa Kigen mentioned.

The lawyer divulged that Ms. Yator divided her 100 acres and sold it to Ruto, when he was a Member of Parliament.

The Deputy President complained that the judge’s ruling was unfair as he was found without fault.

“The honourable judge erred in fact and law by ordering the petitioner to pay compensation plus costs while no fault was found as against him in the process of acquisition, transfer, possession and ownership of the parcel,” the lawyer stated.

In 2010, Muteshi moved to court accusing the DP of grabbing his land during the 2007/2008 Post Election Violence (PEV).

Muteshi alleged that Ruto evicted him from the lush farm in Rift Valley.

Making the ruling in 2013 Judge Ougo stated: “I order the deputy president to pay 5 million shillings to the farmer as compensation ... I conclusively find that Muteshi is the owner of the land. From the evidence before me, it is clear that there were fraudulent activities in the manner the land was sub-divided and sold".
