The prosecution team in the case against government official Dennis Itumbi was on Monday put on the spot after the judge pointed out an oversight on their part.

Magistrate Kennedy Cheruiyot noted that the DPP had not submitted statements from 256 members of Tanga Tanga WhatsApp group who had been summoned by the DCI.
"The court has not been told how many statements have been recorded from the 256 members of Tanga Tanga group who are spread across the Country," he stated.

Mr Itumbi, however, was given an opportunity to take a plea to three charges - making a false document without authority, publishing a false statement and reprogramming a mobile phone.
He denied all charges with one of his lawyers, Mr Katwa Kigen, terming them as ridiculous.
Magistrate Cheruiyot adjourned the case and set August 5 as the pre-trial date and two hearings scheduled for September 2 and 3.
