Confusion as evidence in Waiguru-Karua mysteriously disappears

The Supreme Court in March declined to stop the High Court from hearing afresh Martha Karua's case

The court directed the court's deputy registrar to produce judiciary staff who received Karua's petition with Judge Lucy Gitari directing the staff to explain how Ms Karua's flash disc containing video evidence on voter bribery got lost from the file.

"There is a wide conspiracy. Court has a duty to get to the bottom of the matter. It is incumbent upon this court to exhaust its own internal inquiry. Bring the person who wrote the receipt to explain," Ms Karua lamented.

In March, Governor Waiguru was dealt a major blow after the Court of Appeal set aside the High Court's decision to throw out her election petition.

Later the same month, The Supreme Court declined to stop the High Court from hearing afresh Martha Karua's case challenging Kirinyaga Governor Anne Waiguru's election win.

In the decision read by Chief Justice David Maraga, the court ruled that it cannot stop the proceedings at Kerugoya High Court since presiding judge Lucy Gitari is due to rule on an application challenging her jurisdiction to hear the case.

Ms Waiguru had applied for the stay of execution of Appeal Court order directing Justice Gitari to hear and determine the matter anew.
