Justice Wasilwa issued the directive in a case where activist Okiyah Omtatah has challenged Mahamed's appointment to the NGO Coordination Board.
Mahamed's contract expired in November 2017 but has continued to serve despite a court order barring Matiang'i against renewing his contract.
Mahamed has since then issued a notice of resignation which is expected to take effect from May 1st.

while announcing his intention to leave the NGO Coordination board, Mahamed did not give reasons but only described his three-year term as full of joy and excitement.
"I would like to wish the Board the very best in its endeavours of creating an enabling environment for thriving of the charity sector and for the continuous demand for greater accountability and transparency amongst NGOs," Mahamed stated.
