The High Court in its ruling said that there was no proof of irregularities as claimed by the petitioners who wanted his August 8 election nullified.
Justice Winfrida Onkwany who presided over the case ordered the two petitioners Charles Obera and George Ogake to pay Sh8 million to cater for the costs of the petition.
Last year, Charles Obera and George Ogake filed the petition against Ongeri at the High Court in Kisii, saying that the August 8 senatorial poll was marred by irregularities and they wanted the court to nullify Senator Ongeri’s win and have a fresh election held.
The petitioners through their lawyer Omwanza Ombati said that noncompliance, irregularities and improprieties affected the integrity and quality of the election and results.
In the election, Prof Ongeri emerged the winner while People Democratic Party’s (PDP) Omingo Magara came in second and third place was Jubilee’s Charles Nyachae.
