The supreme court announced that failure of IEBC to open it's servers helped to debunk NASA's claims that their servers were hacked.
CJ David Maraga added that IEBC made a mistake in announcing President Uhuru kenyatta as a winner before verifying all form 34A's, meaning they failed to follow the electoral law.
Minutes after Maraga's team delivered the ruling, Ruto stated that the supreme will of the people was overturned based on technicalities.
Maraga announced that Kenyatta was not found guilty of any charges as alleged by the Opposition as they failed to prove any wrong doing.
This meant that the Supreme court never questioned Kenyatta's win but nullified it based on technicalities of transmission process.
Justice Njoki Chege and Jacton Ojwang disagreed with the Majority ruling stating that NASA failed to prove it's case and that Kenyatta's win should not have been nullified.
“The Constitution of Kenya safeguards the rule of law, democracy and the will of the people,” said Justice Ojwang’. “It is clear to me, beyond peradventure, that there is not an iota of merit in invalidating the clear expression of the Kenyan people’s democratic will.
“I cannot but therefore conclude that the facts based on the evidence of the petitioner’s case are more than weak. The Constitution states that justice shall be served without undue regard to procedural technicalities,"Ojwang said while reading his dissenting opinion.
