Should the Sexual Offences Amendment Bill, 2016 fronted by Busia Woman Representative, Florence Mutua sailed through parliament then randy Kenyans who cannot keep their body parts to themselves may soon find themselves languishing in jail.

According to the Bill, a sexual offence includes contact between body parts with genital organs, breasts or buttocks of another person.

In addition exposure of one’s breasts, genital organs, buttocks or even showing pornographic materials to an unwilling person also amounts to sexual offence.

When Ms Mutua stood to defend her bill she stated

“The issue of ferry comes to mind, where women have been complaining when they are crossing, men come and stand behind them and do indecent act and they have no way to report because  that indecent act is not in the law” she said.

The bill is however controversial since it seeks to criminalize acts some would argue is but innocent human reaction.

Mutua’s bill also seeks for instance to punish anyone who looks at the opposite gender lustfully, offenders risk five years in jail if convicted.

How that can be proofed for sure is a story for another day.

The bill does not stop there; it would be criminal to indecently make contact with the opposite sex in a Matatu or even a ferry regardless of the congestion.

Women for instance sometimes breastfeed in public services vehicles and in the process  expose their breasts, in the same breath would that not pass as an offense against men? Many would argue that by breastfeeding the woman has indecently exposed herself to them without their consent.

In this age of millennial’s where everything is snapped and posted online, one does have the control anymore to choose what will land on their wall and offend them.

A glance through some of the popular socialite’s pages on Instagram like @normadicBeryl will make even the ‘holier than tho’ men and women impossible to react.

Kenyan men and women also have an habit of requesting and sharing ‘nudes’ therefore guidelines need to be provided on what amounts to pornographic content since the same can easily be abused, landing innocent souls in jail.

The Bill also seeks to put an end to instances where sexual offenders use out of court negotiations to evade justice.

The Bill hopes to deny plea to sexual offenders on grounds that such cases have been collapsing on basis of lack of evidence  making it difficult for instance to establish where a rape was done.

The Bill also seeks establish special units specifically tasked to conduct investigations relating to sexual offences.

If the bill sails through expect to do with Saudi Arabia style ‘Moral police’ who will be tasked to nab sexual offences in the act, in the public.

Only that way can the bill ever be fully implemented.
