According to the family's lawyer Edwin Sifuna, Ms Thumbi refused to have the DNA test carried out before the death of Okoth.
The mother of the Late Kibra MP Ken Okoth, Angeline Ajwang and his wife Monica, moved to court seeking to quash a court directive to stop the interment of Okoth.
Ajwang and Monica argued that “there is no dispute” surrounding the interment plan of the Late Okoth.

Thumbi, a nominated MCA in Nairobi, moved to court on Thursday to request for an injunction stopping Okoth’s funeral plans, until Ajwang and Monica recognise her 3-year-old son as a scion of the late MP.
Certified as urgent, the court directed that the interred plans set for Saturday be stopped until the case is heard and determined.
“That in the interim a temporary injunction be and is hereby issued restraining the 1st and 2nd defendant (Okoth’s mother and wife), either by themselves, their servants or agents from conducting the burial, interment, cremation and or in any manner whatsoever dispose of the body or remains of the late Mr Ken Okoth pending the hearing and determination of the instant application interparties,” the directive read.
