All You Need to Know about Forms 34 & 36

NASA flag bearer Raila Odinga on Wednesday morning called a press conference to dispute the Presidential results streaming on the Independent Electoral and Boundaries Commission (IEBC) website indicating that President Uhuru Kenyatta is leading with over 1 million votes.

Mr Odinga stated that the results were not valid as they were not accompanied by form 34 as stipulated by the Constitution.

"The IEBC system has failed; it is the machine which is voting. The NASA coalition is concerned that IEBC is streaming results not being accompanied by form 34(A).We reject all results streamed so far and demand that the IEBC produce Form 34As," the former Prime Minister said.

According to The Elections Act IEBC is to receive provisional electronic results from every constituency. In addition, the IEBC must receive the results as filled in an original form 34 from every Constituency.

The form 34A is where the Presiding Officer at the polling station first tabulates the Presidential results.

It contains details of the votes garnered by each candidate and then details the total number of registered voters in that station, the rejected votes, the objected ones, the disputed and the valid ones.

Form 34 A is then handed to the Returning officer at the constituency level who then fills form 34 B. This is what will be handed to the IEBC boss at the National tallying centre.

The candidate or their agents are then required to sign and ratify that the contents of that form are correct.

On the other hand, form 36 is where the returning officer conducts the final tally of the elected officials for the positions of County Governor, County Senator, and County Woman representative to the National Assembly.
