Court of Appeal makes major decision on Miguna Miguna's case

Another big win for the General

In the ruling, Court of Appeal judges Roselyn Nambuye, Patrick Kiage and Kathurima M’Inoti declined to stop an application by government to have IG Joseph Boinett, DCI George Kinoti and Immigration director Gordon Kihalangwa not to appear in person before High Court judge Luka Kimaru.

“We do not take lightly contempt of court allegations, orders issued by a court are compulsory and must be obeyed by everyone regardless of their status,” said Justice Kiage.

Justice Kimaru had ordered that IG Boinett, DCI boss Kinoti and Immigration Director Gordon Kihalangwa appear in person before the High Court after they failed to present Miguna Miguna in court after his controversial arrest for allegedly swearing in NASA Chief Raila Odinga on January 30.

Miguna Miguna’s lawyer Nelson Havi said that the Court of Appeal had now cleared the way for an unhindered return of the NRM General.

“We did again and upheld the rule of law! Court of Appeal clears the way for the unrestricted and unhindered return of Miguna Miguna to his Country of birth and origin; Kenya. Congratulations Orengo, Khaminwa, Mutula, Ombeta, Soweto, Osundwa, Waikwa, Ochieng and yours truly. Viva!” he said in a tweet.
