This was despite orders issued to Inspector General Joseph Boinnet and Directorate of Criminal Investigation George Kinoti to personally present the Canadian-based lawyer before the court.

Instead Boinnet and Kinot sent two senior officers; Assistant Inspector Stanley Cheruyiot and Amos Omuga from DCI, to represent them.

However, Senior Counsel John Khaminwa, who is representing Miguna rejected the two officers.

At the same time, Rarieda MP Otiende Amollo told the court that Dr Miguna ought to be presented whether dead or alive.

The outspoken barrister and solicitor was supposed to be in court on Monday morning but police did not present him.

Justice Luka Kimaru then directed police to present him at 2PM, an order that was never obeyed.

During the Tuesday court proceeding theDirector of Public Prosecutions assistant Nicholas Mutuku assured the court that Miguna was alive.

Mr Mutuku disclosed that the lawyer had been charged at a Kajiado court noting that there was no need to hold IG Boinnet and DCI boss in contempt of court.
