Miguna exposes secret documents that forced flying squad to arrest him

Miguna who was heading for a strategic meeting presided over by Mr Odinga in Kikambala, Mtwapa, was stopped along the Mombasa-Malindi Highway and detained for a few hours.
Speaking during an interview, Mr. Miguna claimed that he retrieved data of the August 8 General Election from the Independent Electoral and Boundaries Commission (IEBC) servers.
According to the Canadian-based lawyer, the data indicated that Mr. Odinga garnered over 8 million votes while President Uhuru Kenyatta managed about 7 million votes.
“I have the server results of August 8, 2017. These are the figures Raila Odinga got 8 634 76 votes (53%) against Uhuru Kenyatta 7, 675 162 votes (47%),” he said.
During the presidential petition, the Electoral Body was ordered by the Supreme Court to give parties access to the server but the order could not be fully complied with due to time constraints.
The NRM General mentioned that the documents were what led to his arrest in December as he was headed to swear in the former Prime Minister.
“They knew I had the results and that is why they detained me on December 17 when I was going to swear in Raila in Kilifi. I was on the way to swear Raila in and they detained me until the meeting was over," he said.
Miguna, a self-proclaimed head of operations in the National Resistance Movement (NRM), went further to explain that he followed legal means to access the results
“There is a constitutional right to access of information. There is a valid live court order against the IEBC to give access to the server so that we can mine the information and do whatever we need to do with it legitimately legally. That order has not been obeyed by the IEBC and Chebukati, they are in contempt of the court.
“As a legitimate exercise of my right and a keen observer of the law I decided to retrieve the information that IEBC has not retrieved,” Miguna said.
The lawyer challenged Attorney General Githu Muigai to arrest him over the authenticity of the results which he claims will be used to swear-in Mr. Odinga.
"The only way anybody can challenge this document is by going to the IEBC and say look there is an order can you give access or produce documents so that we can compare with Miguna’s documents
"I want Githu to arrest me today so that we challenge each other in court. He can produce his results, I will produce mine and the court can authenticate which one is authentic," he siad.
NASA leader has announced that he will be sworn-in on January 30, 2017.
