Miguna's Deportation takes interesting twist after High Court issues fresh orders

Miguna was deported back to Canada on Tuesday night

Justice Luka Kimaru in his orders directed the Immigration Director Gordon Kihalangwa to swear and file an affidavit explaining how he took custody of Dr. Miguna and got him out of the country.

The High Court further directed the Inspector General of Police Joseph Boinett and the Director of Criminal Investigations George Kinoti to swear affidavits and file them by Friday 9, February explaining how Miguna was released to the Immigration department for deportation.

The ruling was made after State Prosecutor Duncan Ondimu told the court that the IG and the DCI were not involved in the removal of Miguna Miguna from Kenya and that the Immigration department was to be blamed.

Interior Cabinet Secretary Fred Matiangi on Wednesday explained that the main reason the government deported the National Resistance Movement “General” Miguna Miguna is because he was not a Kenyan citizen.

Matiangi through a statement declared that Miguna was not a Kenyan citizen and that is why he ordered for his deportation under the powers vested by section 43 (1) of the Kenyan Citizenship and Immigration Act 2011.
