Man in court for breach of agreement

Lento Nigeria Plc. is a developer and the owner of Classic Estate, Piakasa, Abuja.

Counsel to the plaintiff, Stephen Lawan said his client was asked to make an initial payment of N5 million out of the total sum of N8 million for a three bed room bungalow in the estate.

He said that after paying the money, he was told that the house would be completed in 20 weeks but Lento failed to complete the house as promised when his client checked the site.

The plaintiff’s counsel said that Lento told his client that it had reviewed its price and he must pay additional fee to enable the company complete the house.

The plaintiff said “Lento made an offer of N5 million to be paid by my client with a promise that the house will be completed before paying the balance of N3 million.’’

Wenank, who was in the witness box said an offer was made to him for part payment of N5 million and he applied to the Board of Federal Civil Service for the loan, which was paid on his behalf.

He said that Lento later breached the agreement by asking him to pay N12 million, adding that the price review negated the agreement they both entered.

He said that he was told to raise additional money if the house must be completed as agreed, which he said he  refused.

Mr Earnest Nwoye, the Counsel to the defendant, said the plaintiff was requested to pay the balance of N7 million within three months of completion but turned it down.

He said that the plaintiff signed an agreement of price review, which he also reneged.

Justice Angela Otaluka of the FCT High Court, Lugbe after listening to both parties for cross examination, asked the witness to take his leave.

Otaluka however adjourned the case to June 18 for further hearing.
