DPP issues new statement to IEBC officials after Raila's order

The Mr Keriako Tobiko led team on Thursday sought more time to critically analyse the ruling, ahead of embarking on investigating IEBC officials who might have committed the irregularities in the annulled presidential elections.
Already a team in the DPP’s office is said to be analyzing the judgement to pick key issues that would be investigated against the IEBC officers.

The announcement by Mr Tobiko comes in the wake of piling pressure form the Raila Odinga led National Super Alliance which has been pushing for the resignation and immediate prosecution of IEBC officials who bungled the August 8 polls.
But the sharp contrast emerges as the detailed ruling by the four judges of the Supreme Court who annulled the reelection of President Uhuru Kenyatta did not pinpoint a particular commissioner or official at the Wafula Chebukati led team.
On Wednesday after the reading of the judgement, National Super Alliance presidential team Raila Odinga’s lead lawyer James Orengo vowed to initiate private prosecution against responsible IEBC officials if the DPP delays to probe the matter. He divulged that he will be having private talks with the DPP.
On his part, however, the Independent Electoral and Boundaries Commission chairman Wafula Chebukati, after the verdict that saw President Uhuru Kenyatta’s reelection nullified, asked Mr Tobiko to “urgently and expeditiously investigate and prosecute any officer linked to the election malpractice.”

Tobiko, however, insisted that he would only bring to launch investigation into officials behind the poll illegalities and irregularities once the full judgment is delivered.
The DPP’s Communication Director Beatrice Omari yesterday told a local daily on phone that a team of 105 prosecutors hired to deal with election offences will advise Tobiko on appropriate action to be taken after studying the judgment.
“Prosecution is a process not just taking people to court without sufficient evidence. The team of prosecutors is going to peruse through the judgement and look at the right laws to be applied in the prosecution,” Omari said.
“The full judgment has just come. It is too early for now to demand action because the team has to study the judgement first. Give us time to study then he (Tobiko) will direct.
Raila and his NASA brigades have already singled out 12 IEBC officials they believe contributed greatly to the bungled election and want them suspended or blocked from overseeing the upcoming fresh presidential poll.

She added: “We have been taking action on electoral malpractices since the electioneering period started. Everybody was waiting for details of the judgment and I can assure that action is going to be taken from evidence gathered.”
Independent Electoral and Boundaries Commission (IEBC) Director of Legal and Corporate Affairs has offered to retire days to the repeat presidential election slated for October 26.
Praxedes Tororey, has offered to withdraw two days after the Supreme Court indicted the commission for bungling the August 8 General Election.
