Uhuru’s Team Takes Drastic Step to Overturn Maraga Ruling

President Uhuru Kenyatta’s team has made a rather drastic step as they seek to overturn the decision made by the Supreme Court to nullify the August 8 presidential election.

This is after Jubilee senators resolved to move to the High Court seeking an order to have the presidential ballots used in the August 8 opened, and a recount made to verify the results.

The decision by the Jubilee senators is reportedly part of a strategy by President Kenyatta’s legal team to attempt overturning the verdict delivered by a majority of four Supreme Court judges with two dissents.

It is not yet clear the precedent that would be used to overturn such a decision given that the constitution stipulates that the Presidential petition has to be decided upon within seven days from date of filing.

On Wednesday, Kenyatta’s lead counsel, Fred Ngatia stated that the president’s legal team wanted the ballot boxes preserved for “use in future legal cases.”

Ngatia was also quick to request the soft copies of the full judgements to spend the “rest of the night going through them.”

The Star has reported its sources indicating that Kenyatta’s legal team intends to use the loopholes noted in the minority decision to lodge a new case at the Supreme Court seeking to quash the initial ruling.
