You will be jailed for 5 years if you breach the Kabarak trademark owned by the late Mzee Daniel arap Moi

Individuals or trade corporations who use the name “Kabarak” to sell or market goods and services without permission from the estate of the late former President Daniel arap Moi 's estate will face a fine of Sh200,000 or a jail term of up to five years

The late President Moi had in 2018 registered the word Kabarak as his trademark, under the Kenya Industrial Property Institute.

Moi’s trademark was registered in 45 classes and is one of the first incidents where a geographical location has been allowed as a trademark.

The former President has several business interests bearing the name Kabarak - the small geographical location where he bought his retirement farm.

Among the businesses he owns includes Kabarak High School, Kabarak University, Kabarak Dairy Farm, among others.

In 2002 after retiring as President, Moi chose Kabarak as his retirement home where he has lived over the past 17 years. He is also said to have chosen to be buried at his Kabarak Farm where he will be laid to rest next week on Wednesday.

As per Kenyan law, a trademark owned by an individual is passed on to the inheritor of his estate.

Moi’s longtime friend and confidant Bishop Silas Yego on Wednesday revealed that Moi had spent a considerable time of his last days compiling a will where each of this children will get a fortune.

The wealth is estimated to be in the tens of billions, given Moi's varied interests that range from transport, media, banking, and farming.
