Why Kiambu may fail in impeaching Women Representative Gathoni Wa Muchomba

This is how the law of impeachment works.

The backlash was so great that residents of Kiambu County, even after Gathoni writing them a heartfelt apology letter, still signed a petition to have her removed from the electoral seat.

However, according to the new law, chances that the people of Kiambu may successfully sign her out are quite low.

This is why:

1. According to the law, the earliest she can be recalled is after two years.

2. Gathoni wa Muchomba is yet to be sworn in and according to the law she cannot be recalled before her inauguration.

However, the law has so far made it easier for recalling to occur. The law dictates that:

1. The court availed a provision that for a voter to initiate a recall procedure, he or she must have been registered as one in the area the recall procedure.

2. The provision also barrs anyone who contested the election from initiating the procedure.

For the recalled politicians, the three judge bench comprising of Justice Goerge Odunga, Enoch Chacha and Kanyi Kimondo decided that the impeached persona should not be barred to vie in the by elections unless it is expressly stated by the law.

Gathoni wa Muchomba angered her people after she stated the following on national television when discussing the Paliamentary Service Commission's decision to reverse pay cuts, "I want to be paid well. I want to be honored for who I am."

Now, Gathoni in her apology promised to accept any decision made by the Salaries and Remuneration Commission (SRC) and the Parliamentary Service Commission concerning the Members of Parliament's salaries.
